The lawyers representing Charlie’s guardian, Mary Werner, wife of Shavano Park Mayor Bob Werner, and the lawyers representing Charlie’s guardian of his money (estate) Tonya Barina, has consistently represented to the court that Section 1055 of the Texas Estates Code denies Laura Martinez-Thrash any standing to participate in the guardianship of her common-law husband, Charlie Thrash — when the exact opposite is the true intention of Section 1055.003(d).

Lawyers representing Mary Werner and Tonya Barina have misused Section 1055.003 and their omission of any mention of sub-paragraph (d) of Sec. 1055.003 to deny Charlie the right to an attorney, to strike all evidence from the record that noted their incorrect application of Sec 1055.003, as well as their insistence in refusing to follow the Texas Estates Code Ward’s Bill of Rights.
