Lasting damage caused by San Antonio Express-News’ biased and one-sided coverage of Charlie Thrash’s guardianship

March 21, 2021: Attorneys and wannabe journalists Elisa Reiter and Daniel Pollack write a supposedly informed article about Charlie Thrash’s guardianship that manages to continue the disrespectful tone towards Laura Martinez, along with a complete disregard for the facts as well as points of law, that show these two attorney-journalists have a long way to go before they could show us they are competent at either journalism or law.

The article starts off with the inaccurate statement, “On March 4, 2019, Charles Thrash married Laura Martinez in Saledo at the Black Swan Inn,” showing Reiter & Pollack’s basic ignorance of the facts, and their reliance on what they were told, as the Black Swan Inn is not in Salado, and this is evident to anyone who has reviewed the facts of Charlie’s case, independent of the error-prone Express-News reporting, upon which all other ‘journalists’ and attorneys seem to rely on, without ever bothering to check its veracity. For journalists, we might understand this type of lazy dependency upon another in your own profession.  For attorneys to not realize the Texas Estates Code has been violated in numerous ways in Charlie Thrash’s case shows an abysmal lack of legal knowledge, insight, curiosity, or sense of justice.

For trained and licensed lawyers, these Reiter & Pollack like to include details irrelevant to law, but providing salacious gossip that drives public opinion and makes people spend their money to receive news:

“Thrash and Martinez had been seeing one another for several years; a May-December romance. Martinez is 27 years younger than Thrash.”

Legitimate lawyers with an actual legal case never resort to such legally-irrelevant gossip, appearing to show that Law.com’s motivation in republishing the Express-News lame tidbits is to bolster the credibility of these meritless misstatements, not provide comfort to seniors and their lawyers who now correctly realize the courts could come for them and their millions next.

Similarly, other seemingly law-based websites, such as the American Bar Association Journal and LawsInTexas.com repeat the San Antonio Express-News‘ factual misstatements, while omitting – just like the Express News did — any mention of Judge Kazen’s biased and prejudicial action towards Laura Martinez and her attorney, Phil Ross, in striking all of Laura’s defense from the record. Nowhere in these so-called journalistic accounts of Charlie Thrash’s case is an accurate, truthful representation of Judge Kazen’s unprecedented law-breaking – we’re calling it as we see it. — that masquarades as impartial judicial administration

May 29, 2019 article from the American Bar Association Journal, which omits the fact that Judge Oscar Kazen ordered "a lawyer and his clients to pay more than $220,000 in sanctions for an alleged 'vexatious litigation campaign,'" was able to levy these sanctions because he did not allow the lawyer and his clients to defend themselves. Instead, Judge Oscar Kazen struck the truth from the record and left Laura Martinez without any legal defense against his judicial bias and in our opinion absolutely criminal and corrupt abuse of his judicial power.

Given that the Texas Supreme Court rejected this Petition of Mandamus in October 2020, without giving any reason, we believe Texas seniors subjected to guardianship proceedings can "expect their rights will be summarily denied and their property used to pay their guardian's attorneys to thwart anyone who gets in their way."
