April 16, 2021: Martinez v. Kazen alleges gross negligence, failure to oversee guardians

April 16, 2021: Original Petition in Martinez vs. Kazen is filed in San Antonio, Texas’ 150th District Court “complaining of the Honorable Oscar J. Kazen, in his official capacity as statutory probate judge, and requesting relief pursuant to the Texas Estates Code, Subchapter A, Section 1201.001-3.”

From Texas Estates Code:

Sec. 1201.003. JUDGE’S LIABILITY.
A judge is liable on the judge’s bond to those damaged if damage or loss results to a guardianship or ward because of the gross neglect of the judge to use reasonable diligence in the performance of the judge’s duty under this subchapter.
